TERMS AND CONDITIONS OF SALE

1.         Warranty          -           All parts and labour supplied for normal mechanical repairs    (excluding automatic transmission remanufactures) are guaranteed free from defect for 12 months or 10,000 miles (whichever comes first) - exclusions see front of invoice.

All Automatic Transmission repairs are subject to a 6 months or 6,000 miles (whichever comes first) warranty to cover defective parts and labour ONLY - exclusions see front of invoice.

It is the responsibility of the customer to return the vehicle to Burnside Garage Ltd for any warranty repairs at their own expense at all times.

2.         Liability           -           In any event and in no circumstances shall Burnside Garage Ltd be liable in contract tort including negligence or breach of statutory duty or otherwise for loss whether direct or indirect of profits business anticipated savings or for any direct or in directed consequential loss or damage     whatever beyond that of a duty to excercise reasonable skill or care.

3.         Returns            -           All returns must have Burnside Garage Ltd's prior approval and authorisation.

4.         Fitness for purpose -    No fitness for purpose, warranty or any other guarantee either written or implied is given save that contained in the Burnside Garage Ltd official written Terms and Conditions of sale.

5.         Payment          -           Payment shall be made by the purchaser to the vendor in strict accord with the terms and conditions set out in the vendors invoice.

6.         Title to Goods  -           Full title to goods shall pass to the purchaser only upon full and final payment to the vendor by the purchaser by all sums as invoiced.

7.         Delivery           -           Every effort will be made to meet delivery dates as form part of the official contract of sale however failure to deliver by stated dates shall not render the vendor liable for damage or consequential loss.  Time shall not be the essence of the contract.

8.         Any notice, consent or other communication required by either party to the other shall be made in writing and shall be deemed to have been received within 7 days from the time of writing or transmitting.

9.         Burnside Garage Ltd's Terms and Conditions of Sale constitute the entire agreement

            between the vendor and the purchaser with regard to all goods, services and no

representation, statement, warranty or condition not expressly contained in this contract    or incorporated herein by written accepted reference by the vendor shall be binding upon the vendor as a warranty or otherwise.

10.        The contract shall be governed and construed in accordance with Northern Ireland Law and the Northern Ireland Courts shall have exclusive jurisdiction to determine any dispute arising hereunder.
